Sellers warranty

1. The SELLERS states that they are the legal owners of the above-mentioned dog for sale to the PURCHASERS.

2. The SELLERS state that the DOG is a pure breed and is registered with C.C.C. of Queensland under the name and number listed below, and that the certified pedigree will be signed over to the PURCHASERS at the time and date of the execution of the sales agreement (usually within 4 weeks of processing by CCC (Q)).

3. The SELLERS state that the DOG has been properly cared for up to the date of this agreement, and is presently in good general health. Subsequently to the date of this agreement the PURCHASERS agree to properly care for the DOG and to maintain the DOG in good general health.

4. The said DOG has a health guarantee for serious genetic health problems for 12 months, and to our knowledge is free from genetic defects unless otherwise stated under the congenital and genetic abnormalities section. Should the DOG be sent overseas the health guarantee is not applicable as the dog cannot be practically replaced logistically, however all conceivable efforts are taken to ensure the best quality of standards.

Operative Agreement

1.      The SELLERS hereby agrees to sell, and the PURCHASERS agree to buy the DOG under the conditions of sale and at the price as specified below.

1. As a PET only on restricted papers $(000.00).

 

2.      For the purpose of this agreement, paragraph 1(a) shall mean a DOG with one or more major faults.

 

3. The PURCHASERS agree that within 48 hrs from the date of this agreement to take the DOG to a veterinarian (at the PURCHASERS expense) to certify that the DOG is in good general health and a vet check in 30 days for the follow up vaccinations to complete any injection or worming program that is required at this time. If the veterinarian finds that the DOG has a major health problem that was not caused by the PURCHASER, a replacement DOG will be given provided a veterinarians report is produced, and a follow-up examination by the sellers veterinarian is conducted if the proprietors feel it necessary (at the purchasers expense). The DOG shall then be desexed by the PURCHASERS if they still wish to keep the dog.

 

4.  Whilst every conceivable effort is made to ensure the best quality standards, the seller does not warrant the dog to be suitable as a pet, working dog, show dog or breeding prospect., any advice or opinion which may be offered with respect to the suitability of a particular animal for a specified purpose is offered without any assumption of liability on the part of the seller and is accepted or rejected by the purchaser entirely at his own risk.

 

5.      If the PURCHASER wants to return the DOG for any reason (other than a health issue as stated in paragraph 3), no refund will be given. The original monies gained from the sale of the DOG will go towards the feeding and housing/care and/or possible desexing/medical care of the said DOG until another suitable home is found.

Purchaser Warranty

1. The PURCHASER also agrees that the DOG will not be resold or given away to someone else without prior arrangement with the SELLERS in writing, the DOG was sold under the conditions of operative agreement, paragraph 1 (a), the SELLERS retain the first right of refusal, should the DOG need to go to a pet home or be kept by the purchaser then the PURCHASER is subject to the dog being desexed prior to the resale of the DOG at the PURCHASERS expense. The PURCHASER will notify the SELLERS of the new owners for the records of the DOG’S micro chip number.                                                            

 

 

2.      The PURCHASER is subject to the dog being rendered incapable of reproducing via desexing at the PURCHASERS expense within 6 months of purchase.

 

3.      The purchaser agrees to pay full price for the DOG at the time of purchase.

 

4.      It is understood and agreed that the SELLERS shall not be liable for damages and injuries caused by the DOG whilst in the possession of the PURCHASERS.

 

5.     The PURCHASERS hereby agrees to honour all conditions of this agreement.

 

6.      The Purchasers agree that buying a DOG under 1 (a.b.c.d.) from (SELLERS) kennels has a restriction on the DOG/BITCH. No DOG is to be used at stud/semen [either frozen or fresh, either deliberately or by mistake] over any other bitch owned by the PURCHASERS or other kennels or any associated person through verbal or written agreement with other kennels or under any other kennel name. No progeny is to be sold to other kennels, associates or partners as breeding or show potential from the above said DOG without consultation and agreement from the SELLERS and proprietors John and Anita Fryer of Masterkarn kennels in writing and signed by the proprietors. E-Mail is not considered in writing.
